Schmitt asserted he had text message evidence suggesting Smith was in Georgia for a game involving the Atlanta Hawks. This event occurred the day before Fulton County District Attorney Fani Willis publicly acknowledged her affair with Nathan Wade, the special prosecutor overseeing the case against former President Donald Trump for his role in alleged election interference in Georgia.
In response, Smith stated he could not recall being in Atlanta at that time and affirmed he did not attend an Atlanta Hawks game. Schmitt displayed a poster board with screenshots of text messages as he spoke. He remarked, "I don't think you know that we have this stuff. I will give you a second to process so you don't perjure yourself," adding that he believed Smith had already perjured himself.
During the hearing, Smith mentioned that he remembered attending a University of Maryland women's basketball game around that time, where Caitlin Clark played. At that point, Clark was a prominent player for the University of Iowa Hawkeyes, a detail later highlighted by Minnesota Senator Amy Klobuchar. In a back-and-forth exchange, Klobuchar urged accuracy, saying, "I think that people should have their facts straight before they accuse someone of being a dirtbag, and not get the teams wrong."
